Message Terms & Conditions (May 2018)
Like all tight-knit communities, we need to be on the same page as to the way things work. Please have a read-through of Message’s Terms & Conditions and contact us at president@messageparis.org for any questions! Now let’s get cracking and establish some ground rules:
Terms and conditions
By using this site, you agree to our terms and conditions set out below and including our Email Policy, Social Media Policy, Advertising Policy and Meetings Code (collectively, « Terms »). We may change our Terms from time to time and will publish any future changes to the Terms on this site; if you continue to use our members-only website at www.messageparis.org you agree to the new Terms.
Disclaimer
Message is our village and our members come together to support one another and share experiences: one of the main purposes set out in our Constitution is "to provide help, support and advice to English-speaking mothers, fathers and parents-to-be in the areas of pre- and post-natal care, pregnancy, childbirth and raising children." But as is the case with all village counsel, this help, support and advice is not a substitute for medical advice from qualified healthcare or for legal advice from legal services providers, each based on personal circumstances. Neither Message nor its members are rendering medical, counseling, legal or other professional services – all content is intended solely for the purpose of general education or information. Actually, let us bold this: you should always consult your own physician, qualified health care professional and/or a qualified attorney for specific advice before making any decisions or taking any actions regarding your or your child’s health-care and/or legal options.
Message is not responsible for the content of any linked external sites. The inclusion of a link does not necessarily imply Message’s endorsement of the linked site.
Getting Started
You are responsible for the accuracy of your information on the application form, particularly in regards to being pregnant or having children. Any misrepresentation will be considered a breach of these Terms and Conditions.
As a community, we require all members to use their real names (so no « BabyMama2009 » or « Jean-in-Paris »). Not only do we want to foster respectful exchanges, which are easier to do with people’s actual names, of course, but revealing our names to each other helps promote the village aspect of our association, all the more so when we need to come together virtually.
You are responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your password or screen name. Please immediately notify us of any unauthorized use of your password or screen name or any other breach of security by contacting us at infoservices@messageparis.org.
Information
Information obtained from Message is subject to copyright and may not be reproduced without prior authorization. Message information is not to be disseminated to any legally constituted body or to any person for profit or gain. Member contact information is for internal Message use only.
Use of Website
Members are responsible for all content that you post on Message and by doing so you represent that such content is not confidential and that you have the necessary permission or consent from any other person to post it.
You agree that you will comply with our Terms and any applicable laws. You agree we may moderate your access and use in our sole discretion, such as by blocking, filtering, deletion, delay, omission, verification, and/or membership termination. You agree that we are not liable for moderating or not moderating and that nothing we say or do waives our right to moderate, or not.
Your Contact With Third Parties and Other Web Sites
Your dealings with third parties found on or accessible through the Message website (such as a daycare you use or a nanny you hire) are solely between you and the third party. Links to third parties should not be construed as an endorsement by Message.
If you have claims against third parties related to your use of the Message website, you agree you will not include us in the dispute. You agree that Message will have no liability with respect to any loss or damage of any kind incurred as a result of any dealings between you and any third party as result of their presence on the Message website.
Message uses Google Analytics to get a better understanding of how people interact with our website so we can make it more user-friendly and easier to navigate. Our site uses cookies that help us track these trends but the information we get is completely anonymous and we are unable to identify visitors.
Communicating with Members via Email and Text Messaging
Message is legally obligated to inform our members about certain things to do with your membership (like voting for the Executive Committee) – and this includes our most private members! All members will receive these notices, via email, as mandated by French laws governing associations.
However, there are other times when we would like to reach out and let you know what Message is offering, be it for the association as a whole or for fun events in your neighborhood. Message communicates with its members through the web site and quarterly magazine, but - for both efficiency’s sake and to save the trees - we also rely on email mailing lists and, on rare occasions, text messaging. You agree that Message can send text messages to the mobile number provided in your membership profile (of course you can opt out of this at any time by texting STOP in response to any text received). We also have a general membership mailing list and various area group or social group-related mailing lists. To identify areas of potential improvement on our part, we will send out surveys from time to time.
Understanding that you have a busy life, if we don’t hear from you within 7 days of [your membership starting or renewing / your clicking I Accept the Terms and Conditions], we will take it that you agree that we can send you membership information via the general membership mailing list and your area-specific mailing list.
To inform us that you do not wish to be included in these mailing lists, please send an email informing our VP of Membership (vpmembership@messageparis.org) of this request and allow 7 days for your request to be processed.
Of course you are always welcome to sign up for as many mailing lists as interest you! We hope you will find plenty of activities to enjoy within Message. To facilitate communication between area-specific mailing lists, your contact information will be viewable internally through these groups you choose to join. You may unsubscribe from any list - including the general membership mailing list and your area-specific mailing list - at any time, but you may NOT opt out of receiving the legally-mandated association mailings described above.
We hope you will take advantage of the great opportunities Message has to offer throughout the year. To remember all the fun we have at events, photos of these events will sometimes be shared internally on the Message website for other members to see.
Members’ Right to Erasure
Message wants to emphasize that under the General Data Protection Regulation (GDPR), members have a right to erasure of personal data also known as the right to be forgotten. Members who want their personal data to be erased should notify the VP of Membership by email (vpmembership@messageparis.org) or post at Message, 28, rue Laure Diebold 75008 Paris
Membership Fees
Once joining, your annual membership fee is nonrefundable. But I am leaving France, you say? We have many long-term members who remain engaged in Message from remote posts! Please contact us at vpmembership@messageparis.org and we can brainstorm ways to get the most from your Message membership from abroad.
Prohibited Conduct
You represent that you will not use Message to:
- Violate any law or encourage or provide instructions to another to do so;
- Post any content that you are not authorized to post;
- Post any content that infringes upon or violates any patent, copyright, trade secret, or other property right of any third party;
- Act in a manner that negatively affects other users’ ability to use Message;
- Post anything that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, including by engaging in any denial of service attack;
- Exceed your authorized access to any portion of Message ;
- Remove, delete, alter, circumvent, avoid, or bypass any watermark or digital rights management technology;
- Use data mining, robots, screen scraping, or similar data gathering and extraction tools;
- Collect or store personal data about anyone; or
- Reproduce (other than as necessary to lawfully access the members’ website at www.messageparis.org or for your own personal use), adapt, distribute, make available, communicate to the public, publicly display, or publicly perform any portion of www.messageparis.org or the materials on members.messageparis.org in whole or in part.
In Case of Breach
If you breach these Terms, we can terminate your membership and/or your access to the Message members’ website at messageparis.org immediately. In this case you will not be entitled to a reimbursement of your membership fees. In certain (very, very bad) instances, we may choose to bring in our lawyers and commence legal proceedings – but please, we would prefer not to, so let’s just all try hard NOT to do anything egregious.
Limitation of Liability
Message shall not be liable for damages of any kind arising from any help, support and advice relied upon by a member. Message assumes no responsibility for any consequence relating directly or indirectly to any action or inaction any member takes based on the information, services or other material provided by Message or its members. Members are also kindly reminded that Message does not accept any responsibility for accidents or losses occurring at Message events. Message does not endorse or accept responsibility for any service or product displayed or sold at Message meetings or events, advertised in the Magazine, or made available for sale through the Message members-only website.
Indemnification
You agree to indemnify, defend and hold as harmless Message, its officers, volunteers and agents from any liability, damages, losses, claims and expenses of any kind (including, without limitation, reasonable attorney’s fees and expenses) related to your reliance on help, support and advice provided on the website, at an event or by any other member.
You agree to pay for any losses caused by you and you agree to indemnify, defend and hold harmless Message, its officers, volunteers and agents from any and all third-party claims, liabilities, damages, losses and expenses (including, without limitation, reasonable attorney’s fees and expenses) relating to or arising under or out of any violation by you of these Terms.
Ownership and Intellectual Property Rights
This website is owned by Message. The website’s look and feel, the designs, logos and trade names displayed on it, and the website URLs, are the property of Message, and protected by copyrights, trademarks, patents, or other proprietary rights and laws.
